Special terms and conditions for marketing services

These special terms and conditions shall be part of an agreement between Dun & Bradstreet companies (hereinafter referred to as D&B) and the customer, unless otherwise agreed in writing. In addition to the special terms and conditions for marketing services, Dun & Bradstreet’s general terms and conditions shall apply

 

1. Service description

The customer shall be granted the right to use D&B’s services in order to plan and implement marketing and sales. In addition, the customer may provide D&B with assignments concerning the updating and analysis of registers or target group selection for marketing purposes.

 

2. Customer’s responsibilities and rights to use services

The right to use information shall commence when both parties have approved the agreement and D&B has provided the customer with the service. The customer shall undertake to notify D&B at its own initiative of any changes to the persons having access rights. D&B shall have the right to revoke, with no separate notification, any access rights that have not been used for 365 days. Access rights shall be personal and may not be transferred without the written consent of D&B.

 

3. Data protection concerning D&B’s contact information and personalised marketing register

When the customer uses address and contact information, the information source for addresses shall be stated in accordance with the instructions available on D&B’s website.

The material may be used for two months, after which the material shall be destroyed. The material shall be provided for one-off use only, unless otherwise separately agreed in writing. If several different sources of address information are used for the same mailing or other marketing measure, they shall all be stated separately and specifically in each marketing message.

The material may not be transferred to countries outside the EU/EEA.

 

4. Data protection concerning D&B’s company database

When the customer uses address and contact information, the information source for addresses shall be stated in accordance with the instructions available on D&B’s website. Please see the information concerning the information source for addresses.

The material may be used for two months, after which it is recommended that the material be destroyed. If the customer uses the material after the two-month period, the customer shall ensure that it fulfils its obligations as a data controller in accordance with the data protection legislation. If several different sources of address information are used for the same mailing or other marketing measure, they shall all be stated separately and specifically in each marketing message.

 

5. Intellectual property rights

All intellectual property rights to the disclosed information shall be owned by D&B. The information may not be used for any competing operations or disclosed to third parties without the written permission of D&B. Addresses may only be used for the agreed purpose.
